Note the descrepancies between the police report and the warrant recommendation. Keep in mind the arresting officers completed the police report while Det. Schwein completed the warrant recommendation Also note that Walker argued that Det. Schwein was biased and manufactured the case against Walker.
Note how Walker's statement was included in the warrant recommendation and not as a second page.
Manning claims to possess some of the drugs
Shows that the arresting officer's thought manning was in possession of drugs
Shows how Schwein went against what the arresting officers saw on the scene and backdated tickets for Manning and Nettleton (Not Walker). The tickets are timestamped at 2am (Schwein testified he didn't get to work until 7am) . The importance of these backdated tickets are that the arresting officers had intentions of charging Manning and Nettleton with a criminal charge (i.e possession with intent to distribute) while the others were charged with a misdemeanor. When Schwein got into work he saw an opportunity to change the story and pin all the drugs on Walker.
Shows that Barnosky lied about when he got off work. He said he finished the report at 7am but the evidence log sheet shows him logging evidence after 9am. Schwein also testified that the arresting officers got off work at 7am and it wouldn't even be possible to see them in the parking lot.
Provides a written note from Walker's doctor outlining that he has never been prescribed Metformin 500mg like Prosecutor DeYoung argued. The prosecutor tied Walker to the big bag of drugs using the Metformin 500mg that was found with the rest of the drugs. Walker is a diabetic and has only have been prescribed Metformin 850mg. Proving the prosecutor lied.
Prosecutor DeYoung stated in her closing argument the entire case was a credibility contest. We have provided proof of police lies. If the police can lie so freely then their credibility is shot. Also note that she used some of Judge Hathaway's biased comments to help her own argument.
